What to Expect
🔹 Topic 1: The Draft Mediation Bill: Alton Samuels
The demand for mediation services in South Africa is growing as overburdened courts struggle to meet the need for dispute resolution. Litigation is costly, complex, and often limits public access to justice. To address these challenges, the South African Law Reform Commission (SALRC) has been working on a Draft Mediation Bill since 2019. The Advisory Committee, led by Prof Debbie Collier since 24 February 2024, has released Project 94 Discussion Paper 168 for public comment, proposing a general mediation law for commercial, civil, and community disputes. Input will help assess proposed solutions, leading to a final report with recommendations.
🔹 Topic 2: Low-Cost Benefit Options: Elsabé Klinck
The Department of Health has gazetted a notice calling for input on a report prepared by the Council for Medical Schemes (CMS) on ‘low-cost benefit’ option guidelines and recommendations compiled by the medical schemes and insurance industry.
